These Terms of Service (“Terms”) apply to Hawaii Business Magazine (“we,” “us,” “our”), which is owned and operated by aio, LLC. aio, LLC also owns and operates Honolulu Magazine, Hawai‘i Business Magazine, Hawai‘i Magazine, ESPN Honolulu, and other affiliated brands (collectively, “aio Brands”). By accessing or using this website, subscribing to our publications, purchasing products, or participating in our services, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use this site. If under 18, parental or guardian consent is required for paid services such as subscriptions or purchases.
2. License to Use
aio, LLC grants you a limited, non-exclusive, non-transferable license to use this site and its content for personal, non-commercial purposes.
3. Subscription Services
Subscriptions: For applicable aio Brands, you may purchase print and/or digital subscriptions. Subscription terms, renewal dates, payment obligations, and cancellation policies will be presented at the point of purchase.
Automatic Renewals: Print and digital subscriptions may include an auto-renewal option. If you select auto-renewal, your subscription will automatically renew at the end of each term using the payment method on file until you cancel.
Notice of Renewal: You will receive a reminder notice before your renewal date, as required by applicable law.
Account Accuracy: You agree to provide accurate and current information for subscription fulfillment, including mailing addresses and payment details.
4. Event Registrations and Participation
aio, LLC may host in-person or virtual events, webinars, or community programs (“Events”). By registering for or participating in an Event, you agree to comply with any event-specific terms, codes of conduct, or policies provided at registration.
Information collected through Event registration or participation will be handled in accordance with our Privacy Policy. aio, LLC may use Event registration data to communicate with you about the Event, future events, or related offers from aio Brands.
5. Refunds & Cancellations
Refunds: Refund policies vary by brand and subscription type. Unless otherwise stated at the time of purchase:
– Print subscriptions are refundable on a pro-rata basis for any unused issues.
– Digital subscriptions may be canceled at any time, but refunds may not be available for the remaining term unless required by law.
How to Cancel: You may cancel auto-renewal or your subscription by contacting our customer service team at subscription@aiohawaii.com or by calling (808) 534-7555.
Effect of Cancellation: Upon cancellation, you will continue to receive your subscription benefits through the end of the paid term, unless otherwise required by law.
Third-Party Sales: If you purchased your subscription through a third-party vendor (such as an app store, online newsstand, or promotional partner), their refund and cancellation policies will apply.
6. Promotions, Surveys, and Research Programs
aio, LLC may, at its discretion, contact selected users or subscribers to:
• Participate in surveys, focus groups, or research studies.
• Provide feedback on new or proposed offerings.
• Receive early or beta access to new products or services.
• Receive exclusive rewards, incentives, or promotional offers.
Participation is voluntary, and additional terms or conditions may apply to these programs. Official rules will govern giveaways, sweepstakes, or contests, and will be provided separately.
7. User Content
If you submit comments, posts, contest entries, or other materials (“User Content”), you grant aio, LLC a worldwide, royalty-free, perpetual license to use, reproduce, distribute, and display such content across aio Brands. You retain ownership of your User Content.
8. Prohibited Conduct
You agree not to: Use the site for unlawful, fraudulent, or harmful purposes; post offensive, defamatory, or infringing content; or attempt to disrupt site security or functionality.
9. Intellectual Property
All site content, trademarks, logos, and software are the property of aio, LLC or its licensors. You may not reproduce, distribute, or create derivative works without prior written consent.
10. Disclaimers
Content and services are provided “as is” without warranties of accuracy, reliability, or fitness for purpose.
11. Limitation of Liability
aio, LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the site.
12. Indemnification
You agree to indemnify and hold aio, LLC harmless from claims, damages, or losses resulting from your misuse of the site.
13. Termination
aio, LLC may suspend or terminate your access to the site at its discretion, without notice.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Hawai‘i. Any disputes will be resolved through binding arbitration in Honolulu, Hawai‘i, and users waive class-action rights.
15. Changes to Terms
aio, LLC may update these Terms at any time. Continued use of the site constitutes acceptance of updated Terms.
